Prop 8 likely to remain in place

Sadly, MSNBC projects that the California Supreme Court seems likely to uphold Prop 8. There were three hours of oral arguments today, and based on the Court's comments and questions, it doesn't look good. The one upside is that most likely, they won't invalidate the thousands of marriages that were performed between same-sex couples when gay marriage was legalized for just a few short months.

Still though, I'm extremely disappointed. The Court should issue its ruling in 90 days, probably some time in early June.

    I fervently hope that MSNBC is wrong. The logic behind such a decision would seem to be that some significant majority vote can foist upon any minority whatever it likes, regardless of constitutionality -- that the majority is somehow "more equal" than the minority. Further, by failing to act as a check/balance, would such a decision subvert (however fractionally) the role of the courts and (again, however fractionally) erode faith in same at a time when civil rights are under attack?

    If it does remain in tact than I clearly know nothing of law or the Constitution.

    I mean, the idea that someone could argue that Prop 8 is even remotely ok from a legal or civil rights perspective is INSANE. I hope they take this decision seriously, because if they let this slide, every other state will know they can do the same thing and with probably an easier success rate.

    You CAN NOT pass a law that restricts the rights of a minority group! Either marriage is for every one, or know one. You don't have to like it, but you do have to deal with it!
